Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights consist of:- Pay for all salaries earned (INFO # 3) at the rate consented to by the company and employee.
– Pay of a minimum of base pay (INFO # 1), the suitable Colorado or local minimum wage, and all earned overtime earnings without impermissible reductions from their wages;.
– Pay of all made salaries without impermissible reductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS implements a number of Colorado’s wage and hour and other kinds of labor statutes and labor guidelines, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules web pages for existing and prior versions of crucial Colorado labor and guidelines.
Published Guidance: The Division’s primary types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially approved notices, viewpoints, employment and descriptions on different labor law subjects; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for employees on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If an employer owes you wages, employment you can send your company a written need for payment of wages by mail, e-mail, text message, or other electronic ways. A written demand might be sent to the company at the very same time a Labor Standards Complaint Form for employment unsettled earnings is submitted with the Division. Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and reviewed, a letter discussing the nature of the problem and the quantities declared to be owed is sent out to the company. Investigations Launched by the Division (” Direct Investigations”): The Division may conduct employer-wide direct investigations of possible violations of Colorado wage and hour law. If you would like to submit an idea, please email the Division at cdle_di_tips@state.co.us. If you wish to submit an individual claim for overdue wages, you should fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements website. To appeal a direct examination citation or one or more Notices of Assessment, a supposed employer may send a Direct Investigation Appeal Form.
